NEW YORK — Lawyers for Sean “Diddy” Combs have asked a federal judge to release the music mogul from jail on a $50-million bond, citing unsafe jail conditions and arguing that his conviction does not warrant continued detention before sentencing.

The motion, filed Tuesday, comes nearly four weeks after a jury acquitted Combs of sex trafficking and racketeering conspiracy but convicted him on two prostitution-related offenses following a six-week trial.

“Sean Combs should not be in jail for this conduct,” said defense attorney Marc Agnifilo. “In fact, he may be the only person currently in a U.S. jail for being any sort of john.”

Jail Conditions ‘Unsafe’

Combs has been held at Metropolitan Detention Center (MDC) Brooklyn since September 2024, and his legal team says the conditions there are dangerous. They claim inmate fights have occurred in his unit, putting his safety at risk.

His defense argues that people convicted on similar prostitution charges are usually allowed to stay free until sentencing.

“His detention should qualify as an exceptional circumstance,” the motion reads.

The prosecution has not commented on the latest filing. However, U.S. District Judge Arun Subramanian previously denied an earlier release request, pointing to evidence of violent behavior during the trial.

Cleared of Most Serious Charges

Combs, 55, was found not guilty on July 2 of sex trafficking and racketeering conspiracy charges that carried potential life sentences. He was instead convicted on two counts of transportation to engage in prostitution, which could lead to up to 10 years in prison per count.

Prosecutors alleged that Combs used threats, physical force, and the influence of his Bad Boy Records empire to coerce two ex-girlfriends into taking part in drug-fueled sex acts with male sex workers — allegedly known as “freak-offs.”

Combs pleaded not guilty, and his lawyers claimed the women participated willingly.

Defense: Diddy Didn’t Profit from the Acts

In Tuesday’s filing, Combs’ legal team argued that the charges were unusual because Diddy didn’t profit from the prostitution acts. They say that most people charged for similar offenses are not jailed before sentencing — and that Combs’ celebrity status may be influencing the case unfairly.

Combs’ sentencing is set for October 3, and he faces years in prison if the court chooses to impose the maximum penalty, though sentencing guidelines suggest a lighter punishment.
